Elon Musk Speaks Out in OpenAI Trial Over Alleged Charity Misuse

OAKLAND, California — Elon Musk testified Tuesday in a high‑stakes trial against OpenAI, arguing that the ChatGPT maker abandoned its nonprofit mission and betrayed public trust by pivoting to a for‑profit model.

“If we make it okay to loot a charity, the entire foundation of charitable giving in America will be destroyed,” Musk said on the first day of proceedings in federal court.

Musk, who co‑founded OpenAI in 2015 with Sam Altman, is seeking $150 billion in damages and wants the company returned to a nonprofit structure. He claims Altman and President Greg Brockman broke their original promise to develop safe, open technology for humanity’s benefit.

Altman’s lawyer told jurors that Musk himself pushed to turn OpenAI into a for‑profit business, and only sued after he lost control and started his own rival company, xAI. “What he cares about is Elon Musk being on top,” the lawyer said.

Musk testified that he has “extreme concerns” about powerful smart systems, and that he provided roughly $38 million to OpenAI’s early work. The trial is expected to last several weeks, with Altman and Microsoft CEO Satya Nadella also scheduled to testify.
