In a direct and timely message, New York City Mayor-elect Zohran Mamdani took to social media on Sunday to clarify the legal rights of immigrants during encounters with U.S. Immigration and Customs Enforcement (ICE). His video, released days after a federal immigration raid in Manhattan, serves as both a reassurance and a practical guide for the city’s immigrant communities.

“We can all stand up to ICE if you know your rights,” Mamdani affirmed, vowing to protect New York’s three million immigrants. The incoming mayor, who will be sworn in on January 1, outlined several critical protections:

  • The Right to Remain Silent: Individuals are not legally required to speak to ICE agents. Mamdani emphasized that “ICE is legally allowed to lie to you, but you have the right to remain silent.”
  • The Right to Refuse Entry: Agents cannot enter private spaces such as homes, schools, or non-public areas of a workplace without a judicial warrant signed by a judge. Mamdani stressed that people can—and should—refuse requests for entry unless such a warrant is presented.
  • The Right to Film: It is permissible to record ICE agents in public spaces, provided the filming does not interfere with their duties.
  • The Right to Ask if You Are Free to Go: If detained, individuals have the right to repeatedly ask, “Am I free to go?” until they receive a clear answer.

The video follows a week of community action, including demonstrations last week when ICE attempted operations on Canal Street near Chinatown—a neighborhood that saw similar protests against an immigration sweep last October. Mamdani’s message reinforces a stance he has consistently championed: “New York will always welcome immigrants, and I will fight each and every day to protect, support, and celebrate our immigrant brothers and sisters.”

This public guidance arrives amid a broader national context of increased federal immigration enforcement under the Trump administration, including recent operations in cities like New Orleans. Notably, Mamdani held a surprisingly cordial meeting with President Trump in the Oval Office just weeks ago, highlighting the complex interplay between local advocacy and federal policy.

By clearly outlining these rights, Mamdani aims to empower vulnerable communities with knowledge, turning fear into preparedness as the city prepares for his administration.
